What Are My Chances Of Getting A Refund

I have asked the dealer for a refund on the used Vrs I bought in August. Firstly my car had oil in the coolant which took 5 weeks to fix ( plus to new head gaskets) then since then had two crack coolant pipes. I have told the dealer I only have a problem with the car and not them. Do you think I have any chance to getting my money back??.

Re: What Are My Chances Of Getting A Refund

Generally speaking...refunds only really tend to be when something isn't "fit for purpose" - there's no obligation if you're just not happy with the product.

So...if the dealer has resolved the faults, you're unlikely to get a refund out of them. If there's still issues and you've given them sufficient time to fix it, you can say the car isn't fit for purpose.

Of course, only the dealer will be able to tell you if they'll give you a refund though....

Yeah, I've read most of the posts you've made on it...has the dealer put it right now, or is it still having problems?

Highly unlikely imho. What makes you want your money back, or is it still being troublesome?

Re: What Are My Chances Of Getting A Refund

The dealer has fixed the oil fault and is currently fixing the second broken coolant pipe. What ever happens I will be getting rid. Lost faith in the car, I have 6 cars in 12 yrs and I have never had much trouble, the Vrs is the most expensive car I bought and I have had the most problems.

Re: What Are My Chances Of Getting A Refund

the pipes will have been weakened by the oily gunk running though them i would imagine. they wouldnt have replaced them after the coolant problem, porbably checked them out and cleaned them and thought they would be ok. i think to get rid now would be hard as the dealer can argue that there was no way they could have forseen such a failure, plus they have now recilfied the issue.

afterall the work thats been done it shouldnt go again, and im sure the car will be reliable if they've done the work right of course

Re: What Are My Chances Of Getting A Refund

Basically, the retailer isn't bound over by law to give you a refund.

Sales of Goods states "Repair or suitable replacement" meaning your statutory rights don't warrant your money back.

If you want to get your money back from the dealer it would probably require litigation unless they are a very, very nice dealer. If you don't want it you would be better off just off loading it at another dealer as a part ex or to sell it on.

Sounds like you have had a lot of bad luck with the car TBH. It happens.

This what I was told about oil making the pipes weak.

Erm, why?

Some of the most reliable cars I've had, have been the cheap and old.

Buying a new / nearly new car guarantees nothing... bar the right to thrust it back at who you bought it from.

the oil rots the inside of the rubber pipe , causing it to swell up and perish

i think i said it would need all the pipes replacing in one of my earlier posts in your original "oil in coolant" thread

i think you were unlucky with the original problem but the further problems should have been foreseen by the dealer methinks

Sorry to here you're getting rid......

You'd have loved my previous car then..... 2001 Polo GTi which i bought when 20months old..... Had it for 3 years and just within the remaining warranty (15 months) i had somewhere in the region of £2500 of work done on it..... It was in the dealership approx 15 times.... one of which was for a recall that took them 6 weeks to complete!!!!

Even though i had all those probs i still kept the car cos it was still a polo GTi and a gem when it behaved itself.

Best of luck with your next car be it Skoda, VAG group or A.N.Other.

Cheers

Dave.

I had similiar problems, but probably a bit more stronger than you, and being a bit more stranded.
It took many weeks, and a solicitor to deal with the case. I eventually got a refund...

Re: What Are My Chances Of Getting A Refund

Meeting the boss next Friday but I doubt I will get any refund, the dealer has already giving me a free service,Gap Insurance and new back tyres. They have already spent a lot on the car fixing it and giving me these freebies so my chances are nil.

Say "Hi, Bought this Fabia a few weeks ago, and got home, my Mum had already gone and gotten one for me, so I don't need it. Under the Sales of Good Act .........."
Then, if you can, pick the Fabia up, and put it on the till.

Re: What Are My Chances Of Getting A Refund

Got a e mail back from the service manager telling me that he will not accept a swap, so will have to ask the principal when he gets back from on Holiday on Friday. Looks like I will be keeping the car for at least 12 months.
