| Briskodian | Any "no win, no fee" experts here? I may soon be wanting to take legal action against a company. If anyone here has experience of no win, no fee solicitors or maybe works for such a firm please let me know. Thanks. |

| Briskodian | No win no fee normally relates to personal injury claims with a similar (ish) scheme for employment matters.Is it? Watch out for ambulance chasing claim companies.Normally not lawyers,they just flog your case on to a firm of solicitors If it is a different kind of case then there aren't many lawyers who will do no win no fee. Best to ring Law Society for a recommendation in your area (or check their web site ). |

| BEWARE!!! I got ripped off due to being totally inexperienced. I phoned up a 'well known' no-win-no-fee company who advertise on the tv. They sent out a guy who seemed very genuine and who assessed my case to see if it was worthwhile in pursuing...it was apperently. He said my claim would be in the region of £2000 but before he could proceed with there 'specialist solicitor' I would have to take out an insurance policy that 'paid for itself'. Alarm bells should have been ringing at this point I guess ![]() To cut a long story short this 'insurance' was to protect me from getting a large solicitors bill if I didn't win, and if I didn't win then the 'company' would pay for the insurance bill (£980 iirc). Great I thought I can't lose. I also failed to read the small print in that this WAS NOT the solicitors fee which would be in addition to the insurance fee should I win. In the end I did win and was eventually awarded £2350. - £980 insurance policy - £820 solicitors fee (it was agreed that I would have to pay this win or lose) - £150 admin fees So after numerous 'physicals' required by my opposition and time off work etc I recieved the princely sum of £400. Do yourself a favour m8 and just take the time in phoning around for a good solicitor. Most if not all of these 'no-win no-fee companies operate in similar if not the same manner. If your sure they are liable for damages then you have no need to worry if you use a reputable solicitor, who should fight for his fees to be paid by the opposition and not you if you win. You live and learn I guess ![]()

| Dont know how big claim is but Check how much you can claim through the small claims court, it might be worth trying & gives minimal financial outlay for you. Also try & find out how solvent the company you are claiming against is, theres no point winning a case if they have no money, they simply go pop & start with a new name !!

| Briskodian | Hi The perceived wisdom tends to be that they cannot win cases that you could not win yourself - i.e. the facts speak for themselves. For people who are not able to do their own research or are fazed by form-filling, there is perhaps a different perspective, although it might be said that those people are the most vulnerable. I would simply suggest that you explore other avenues before "No win no fee". By the by, I thought it was now illegal to charge insurance etc upfront; also to take their fee from any compensation awarded (i.e. they get their fees from costs awarded if the other party is indeed found to be at fault.) | Briskodian | Some firms are willing work under a conditional fee agreement (no win-no fee) but the amount in dispute will have to be over £5000, otherwise costs cannot be recovered, and the firm must be satisfied that not only are you very likely to win but also that the company will pay up without a fight. No win - no fee works so well in personal injury claims because almost all defendants are indemnified by an insurance company that the solicitors know will pay up when told to do so however it is by no means guaranteed that non-insured defendants will honour a CCJ without expensive and time consuming enforcement action. For this reason it can be very difficult to find a solicitor prepared to take this risk. I am a lawyer!! Last edited by Rydal; 29-09-2005 at 20:00. |

| Briskodian | If your claim is less than £5000 you can pursue it yourself through the small claims procedure. Very easy and informal and except in exceptional circumstances you won't get landed with the other side's costs if you loose. The downside to that is its quite difficult to recover your costs if you win - that is why it is best done DIY. | Briskodian | my dad did ok out of his, was awarded one hundred and fifty thousand pounds, everything has changed recently with no win no fee. You dont pay the costs out of your settlement anymore, it gets paid on top of the settlement now. What kind of claim are we talkingg |
