| Re: Girlfriend in car accident - advice please!!! i know what youre saying i still have a case going through where a woman swerved from her side of the road at me causing me to swerve off the road to avoid her. had swmbo and minitext in the car too so i aint gonna put them in danger, but she tried similar claiming i swerved onto her side of the road. still waiting for the insurers to sort it. as much as i want to ring them and pester them for my excess money im gonna wait and see what happens and any of this 50/50 crap will be thrown back at them. However they do know i have photos taken at the scene, this is always good as the other party never bother with such thing and gives you more credible evidence as the saying goes "a picture paints a thousand words" something which later you may need to prove your innocence. |

| Briskodian | Re: Girlfriend in car accident - advice please!!! well the good lady got pics of his car and the "damage casued" and it looks like a perfect straight line, will post up later, he insurance have called her asking for her 3rd party excess of £250, she promtly told them that they were not having it, and it was a fraudulent claim that the 3rd party are making, calling in at the police station again tonight, ![]() Last edited by bobjim; 03-10-2008 at 14:50. |

She really must go back to the police, and insist that they record and investigate her complaint - emphasise the fact no accident took place, road rage and threatening behaviour did - whatever happened, and that there was no damage on her car, the insignificant damage on the other car was inconsistent with the claimed impact, and that it is an attempted fraudulent claim - it is NOT just the business of the insurance cos, but with so many things these days the Police need a kick up the ..... to do their job. |

I was on a lesson many years ago, my pupil pulled away at a roundabout and stalled, guy behind hit us..... he was perfectly reasonable, gave details , we all went on our way... then when it came to insurance report time, he blatently LIED and said we rolled back into him..... I have legal protection, and set the lawers onhim... told him we were going to court to state that he is lying and its a fraudulant claim (I suggest you do the same with this lying joker you're dealing with) that we would woud state in court what actually happened ect ect (all sorts of other stuff, like other driving instructors backing up in statements what the procedures are when a pupil stalls ect, and that he HAD to be lying......) his lawers, on behalf of his insurance company, then caved and backed out of the court date, and paid up..... took a year to resolve though, i had to get my car repaired by my insurance company, and wait for the money to come back from him.. was quite pleased we managed to get loss of earnings from him too for all the time we took off ![]() good luck .
