| ..........due to an unfortunate incident my Son's Fiat Panda 1.4 16v has been written off by his Insurance Company. It was a 57 plate (Feb 08) Blue Fiat Panda 1.4 16v (100 bhp) with 5k on the clock. So........Does he get a similar car/colour/mileage etc and do we have to except the replacement car.....First time we have had this experience so we are all in the dark......Any advice/comment welcome................Thanks Andy.. ![]()

In my limited experience, the insurance company will make you an offer for what they think the car is worth. Chances are it's way off the actual value and you'll likely want to reject it. If you want to speed up the process, go on Autotrader and find adverts with similar aged, spec, colour Panda's and send them the advertised prices. The other option is he can buy the car back from them and get it repaired which, depending on the damage, may be an option.... Chris

| Re: HELP required Please...Insurance write Off / Replacement Car..... agree with scooby chris here, they will want prices of similar cars (inc spec) so have a look in autotrader and your local paper and refuse the first offer as they wont give you the best pay out on the first offer. |

I know nothing and it's probably of no help at the moment, but there have been discussions on here about gap insurance which might be worth a read for the future as it's meant to take up the difference when insurance value payout is less than replacement value (I think). Reading between the lines, such insurance wouldn't be necessary if insurance companies paid top dollar, so, as said earlier, having some sort of negotiating info at the ready would be no bad thing. I'm sorry to hear of your son's bad luck and also hope no-one was injured. Regards Mo |

I also had my fiesta st stolen about 4 months ago and i was paid out in 3 weeks.if thats any help on time scale |

Replacement vehicle is offered by some insurance companies but not all, if you have that cover - for a replacement car in the first year then it should be a new car. If it's just a fully comprehensive policy they'll just pay current value, as already sad first offer will be a 'chancer'. If the accident was a non fault and he has motor legal protection you can pursue the third parties insurer for any losses.

Thanks for all the replies, the only thing dented is his pride and his wallet, £750 excess .............He's only just 18, he's learning. The car was on finance, will the Insurance company pay the finance company what he owes and then is that the end of it or will he have to take another car ?..........![]()

If he has replacement car in the first year then it may be open to discussion, if he has an ordinary fully comp policy then they just offer what they can get away with based on current market value.

It's quite common but not universal that they will replace a vehicle that's been written off in the first 12 months with a brand new one. If they don't have this clause then it's the standard thing that they will offer you the market value of your car. As others have said it's very likely that the first offer will be too low so you'll need to prove that you need a certain amount to replace it with an equivalent vehicle. Main dealer adverts are the way to go here. Also you don't say who's fault it was that it got written off. If it's his fault then it will be a claim from his own insurance company and the excess will apply. If it's not his fault then you should be looking at a claim from the third parties insurance - either direct or by claiming on your own and then getting them to reclaim the costs. If that's the case then you shouldn't lose out on the excess though it may be a case of it being paid out by your own insureres first and you get the excess back when it's all sorted out. Finally , it's also not unheard of that in the event of a total loss claim the policy is terminated - you don't get the remains of the year transferred onto the new car. Even if they have just replaced your car for you , you may struggle to get it insured as you'll have an "at fault" claim and no NCB

A good price considering we bought it 4 years warlier for £3 and when it got written off the values varied a fair bit. Only downer was £400 excess It has gone the other way with my Skoda. I bought it for £750 and last year the insurers were going to write it off for £1100 after it got sideswiped and only had 1 damaged panel. I did have to pay the £100 excess initally but got that back Hope your sons ok though. |

Unless he has gap insurance, then you son will also have to pay the difference between the insurance settlement figure and the outstanding finance balance. This could be quiet a lot if the car was nearly new and the finance over a long period.

It's just a matter of whether his policy will replace the car or pay market value and that depends on what's in the T&Cs. It sounds like the best option would be a good cash sum so he can clear the finance and then see what he can afford to buy and insure after.
