| In an earlier tread I explained about my Son's Fiat Panda 100 bht which has been Written off...... http://briskoda.net/roadside-hotel/h...nt-car/119633/ ...........So we rung the garage where the car is and said " Seen as the cars a write off can we come over and collect some personal stuff out of the car please " the reply was " What write off ...........The car will be ready Friday, it's been repraired "....Seems like there's been a Major C0ck up and my son's car has been mixed up with another Fiat panda.......Anyone else experienced this problem

If an insurance company declares a car a write-off and intends to pay its value in settlement (according to their valuation) then presumably the car would become their property to dispose of or sell on as best would suit them? In this case, the above would essentially be tantamount to fraud if the car is being repaired and ready to go again if a genuine mistake had not happened, though to suggest such would potentially be libellous. Many more phone calls to the insurers methinks. I know insurers have a repair-cost versus value equation re what they consider to be a write-off but it sounds like more info and explanation needed here from the insurers. No help at all, but others will have a handle on these things ![]() Mo |

When I got hit and run in my MK I the insurance Co decided to write to my father declaring his MK II a total loss, so these things to happen.. I'd call the insurance co, ask them to get to the bottom of it and ask for a good will gesture for the **** up. Suggest maybe they might like to make a contribution to the excess (£100 maybe) if they offer something.

| Re: Insurance/Write off................The Plot Thickens... The explanation is that most insurance are so outsourced and offshored that they don't knwo their ar5es from their elbows. I spent months trying to get my excess back after someone hit me last year, and I was finally told by the insurance companies appointed claim handler that my case had been closed because I hadn't supplied information they'd asked for (which I'd already supplied. Twice). The same day I got a letter from the actual insurance company saying the claim had been settled in full. I had to go back to the claim handlers and tell them -and ask when I'd get my excess back. They sounded totally nonplussed, couldn't wait to get me off the phone, then rang me back to say it would be through in a few days, which it was. I asked how much they would pay me for my hard work in settling my own claim, and they declined to comment!Hopeless, just hopeless. Phil |

| Re: Insurance/Write off................The Plot Thickens... I'm not sure that there is a problem. The car was only about 6 months old, new replacement price about £11k. Unless it was rolled and almost completely trashed (which seems unlikely as your lad was unijured and no-one else involved) it's very unlikely that they would write it off if it's repairable for a lot less - which it seems that it has been. I wonder who told you in the first place that it would be written off - did you have that in writing, or was it just a throw-away comment over the phone? No body shop is going to start repairs without written authority from the Insurers, so I guess that they have been told officially to proceed. Looks to me like it's a win - win situation. Your lad gets his car back, repaired with a 3 year warranty, the garage gets the work and the Insurers pay out less and the Finance company carries on getting the monthly payments. Everybody's happy, except your lad who has to stump up the excess - put that one down to part of the learning curve. As for "negotiating" part of the excess back- No chance |

I know plenty of people who have had £50 or £100 discount on the excess or a cheque because the insurance company messed up. If you can prove it's caused you a cost, eg your calls to them and chasing etc, then I don't see why £50-£100 is unreasonable. After all if the mistake had not happened you would not have to chase it all up.
