| Briskodian | Returning home from work tonight, passed one of those safety camera vans and I think the speedo at the time was 35mph or just under (30 mph limit). Got a number of questions if any can help or give advice. How long does it take to get the NIP? Do they work to certain tolerances and there is no action if the limit is only broken by a few mph or do you still get the NIP even at 31mph (Not surprised these days if that was the case)? Is it automatic 3 points and £60 fine or do they offer some sort of driver safety awareness course instead of points (Have to pay some sort fee though). Thanks |

If you were doing an indicated 35mph, chances are you were only fractionally over the 30mph limit anyway so you'll probably be ok Normal ACPO guidelines are 10%+2mph above the limit which would be an actual 35mph....Chris

I wouldn't worry about prosecutions from a safety van if you're around 5mph indicated over the limit - Your real speed was probably more likely to be 32 anyway, which is within tolerances. I went past one on the A38 dualie near Plymouth before Xmas at an indicated 82mph (saw it too late) and never heard anything. I think the vans just tend to nab those at say nearly 40 (real speed) in a 30, and so on.

Had a chat online with a certain work associate who is not too far from being banned drove past one at 38 mph last November and not heard anything, so she presumed it wasn't 'active' at the time. |

With the number of cameras around these days thousands of people are now being caught for fractionally over the limit. Also with some police forces they offer a "speed appreciation course" as an alternative to the points etc if you are slightly over. My Wife had to endure one last year having been caught at 35 in a 30 in Oxfordshire. If you are sweating on the licence before you fill out the Im guilty form ask for a copy of the picture to ensure it was you driving & it was your car, they can make mistakes If its not clear it might of been a friend/wife/girlfriend & if your not sure who was driving the car at the time you cant plead guilty. Its an offence to state on the form anything that you believe might be untrue so simply state that & ask if there is any way they can enhance the picture to clarify the driver.You will then be prosecuted for failing to disclose the driver as thats the way the system works but at no time have you failed to declare, just asked for help in clarifying who was driving, it will then be court but you stand a good chance of getting off BUT remember its illegal to knowingly make false declerations & if convicted of that its a serious offence. If convicted of failing to declare the fine & points are the the same but you get costs of about £60 added, the downside is the endorsement is a diffetrent one & it will hike your insurance more than speeding

I definitely WOULDN'T go down the road of failing to disclose driver details, as the fine and points are then at the discretion of the magistrates, and are likely to run into hundreds of pounds PLUS court costs !!!!!!!!!!! If you are unlucky enough to get done...the cheapest option is to take it on the chin !!!!!!!!! |

For everyone who knows her, its a shock as she is a careful driver. Off a roundabout which turns from 40 to 30, and a no quibbles endorsable offense. Seems harsh, but cant complain...
