| Briskodian | Swmbo just off the phone to her mum. Today when they were out in the car a halfwit (known to them) tailgated them for about 2 miles through a built up area, until they went their seperate ways at a set of lights. As they passed her, my mother in law gave the tailgater a middle finger salute and thought no more about it.However, my mrs just off the phone to her mum who has had the police at the door claiming that this halfwit has reported the pair of them for giving her a rude gesture! Surely this isn't an offence? I don't have any details of what was said etc but i just think if that's a prosecutable offence then surely we'd all be up before a bloke in a wig at some point? anyone know what the chat is on this sort of thing as far as the police are concerned?

| Section 5 public order offence. It is an offence under Section 5 of the POA if you use threatening, abusive or insulting words or behaviour or disorderly behaviour within the hearing or sight of a person likely to be caused harassment, alarm or distress. Sticking your fingers up at someone is indeed insulting (why else did she do it). Non arrestable after the event , but you can be interviewed under caution and taken to court for it. Could also be a S4A offence which is more serious
