Legal Position

According to my expensive lawyers... "It is not possible, in either the US or EU, to be pursued under law, criminal or otherwise, for watching, listening to, reading or even being in possession of, material which was distributed, broadcast or otherwise published, in violation of copyright. The legal responsibility, in all cases, lies with the publisher, distributor or broadcaster of the material."

All the mp3 files located by Clickster are hosted on openly accessible web servers and so therefore, the presumption must be that, the webmasters/companies concerned have the necessary permissions etc. to distribute this material.

The legal cases brought by the recording industry against P2P users, in both the States and Europe, were successful because of the 'File Sharing' element of these networks. The individuals sued were all guilty of 'sharing' and therefore 'distributing' material in violation of copyright. Not one has been pursued for 'downloading'.

Of course with Clickster, there is no file-sharing. So yes, there are possible legal implications for the webmasters who are making these mp3 s available to anyone and everyone on the Internet, but not the end user.

I would agree, still not legal.

If you bought a watch in a pub that turned out to be knicked, you would have to give it back to the rightfull owner. You may not face prosecution if you can prove that you reasonably thought that the watch was legitimate.

Now, getting mp3's from the internet, in a time when the publishers are starting to prosecute end users/ISP's etc and using the excuse that you thought they were legitimate will not wash.

Do it at your own risk, remembering that every time you move around on the 'net your IP is logged as to where you have been and downloading. That IP is very very traceable.

Thats criminal law not civil law which is what copywrite falls under so it's far from the same thing.

Yes , downloading (and not uploading as you do at the same time with bittorrent) is a civil matter and not a criminal one.
It slightly reduces your chances of getting a day in court , but it doesn't change the legality of this site and their disclaimer is laughable

But downloading an mp3 and buying stolen goods are FAR from the same thing... which was my point..

As for that site who cares they can't sue every single person that downloads mp3's the court system alone just wouldn't be able to handle it, it would be much more cost effective to go after the source(s) of the files.
